This privacy policy describes how Televate, LLC (Owner) collects, uses, and shares your Personal Data when you allow us to access to your data in connection with your use of our mobile application, Pinpoint.

The purpose of this Privacy Policy is to inform you about our privacy practices and to ensure that you understand the purposes for which we collect, process, and share your Personal Data.

Our goal is to collect mobile network information and performance data to inform our customers on their mobile service qualities and to help in enhancing their mobile services.

Types of Data collected and Use

Among the types of Personal Data that this Application collects are: phone number, IMSI, cell network identities, and geographic position.

Pinpoint uses the information to place the user in the right account and produce coverage maps for the account (each account consists of a group of users).

Personal Data is collected automatically when using this Application.  Data is stored on your device temporarily until it is securely transmitted to Pinpoint secure cloud services.  User is responsible for securing Data on User’s device. The Pinpoint service aggregates the performance and coverage data collected by a collection of end-user devices.  This aggregated data is provided as part of the service that creates private-crowd sourced coverage maps for a subscription fee to the account administrator.  This aggregated data, which is the main product of the service, contains no personal or sensitive information.

The account administrator provides your phone number in order for Owner’s service to accept your personal and sensitive information into Owner’s cloud services.  Your personal and sensitive information will only be disclosed by Owner to the account representative of the agency authorizing the use of the Pinpoint app if requested by the account representative. By accepting this arrangement, you understand that the account representative will have access to your personal and sensitive information.  The personal and sensitive user information is never disclosed to other third parties for marketing or any other purpose by Owner.

Data Disclosures

Phone Information

Pinpoint will request access to certain personal and sensitive Phone information, including your phone number, carrier name, carrier number, and phone model.  Pinpoint collects this Phone information to allocate your device’s data to your organization’s account and your cell carrier, and identify specific performance characteristics and capabilities of individual phone models. For security and privacy, the phone number is transmitted to Pinpoint secure server as a cryptographic hash.

Until you exit the app, Pinpoint collects, securely transmits via encryption, and securely stores this information automatically and continually to create comprehensive carrier coverage maps where you travel. Pinpoint will only collect, transmit, and store this data for users with an active Pinpoint account.

Pinpoint data is owned by our customers, and the raw data, including this Phone information, is provided only to your account administrator if requested.  Televate will not sell or otherwise provide this data to third parties or use the phone numbers for communications, sales, or marketing.

File Storage

For troubleshooting purposes, Pinpoint stores a log file that includes app start, app stop, and app sync information in your downloads folder. Pinpoint does not automatically upload this data, and Televate will only get access if you choose to provide the file manually.

Location

To create accurate maps of the network performance and coverage data you collect, allow Pinpoint to use your location all the time.

Pinpoint collects this location data even when the app is closed or not in use. This data will be automatically transmitted to Televate’s secure server.

Age restrictions

The Service is not directed to children under the age of 18.  Users declare themselves to be adult according to their applicable legislation. Under no circumstance persons under the age of 18 may use this Application.

Mode and place of processing the Data

Methods of processing

All Personal Data transmitted to Owner is encrypted to Owner’s secure cloud services.  The Owner takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data.
The Data processing is carried out using computers or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Owner, in some cases, the Data may be accessible to certain types of persons involved with the operation of this Application (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner.

Legal basis of processing

The Owner collects and processes your Personal Data based on your express consent. You are free to remove this Application at any time, and you can turn off data collection at will.  Please contact Owner to understand how to turn off data collection.

Place

The Data is processed at the Owner’s operating offices and in any other places where the parties involved in the processing are located.  Depending on the User’s location, data transfers may involve transferring the User’s Data to a country other than their own.  This Application is not intended to cover any data imported or exported from the European Union or the European Economic Area.

Retention time

Personal Data shall be processed and stored for as long as required by the purpose for which they have been collected.  In some cases, Owner or its customers may seek to understand the change in carrier network availability and performance over time.  Owner will retain the data through the customer’s subscription period.  Owner will remove the customer’s data upon request after this period. But Owner retains the right to delete the data at any time.

How the data is used

The raw, Personal Data provided by the User is aggregated into general carrier coverage and performance reports and maps in work products produced by Owner.   Owner may provide its customers’ raw, Personal Data upon request.

Details about the right to object to processing

CCPA

Under California Consumer Privacy Act, if you are a California resident you have certain rights regarding your personal and sensitive information.  By accepting this privacy policy, you opt in to authorize Owner to share your information with the account representative as identified above. However, you can opt out at any time, at which point Owner will deactivate your device and this Application will cease collection and transmission of any personal and sensitive information from your device.  You can also request that Owner delete your personal information. To make such requests, please send an email to pinpoint@televate.com with “Request for California Consumer Privacy Act Action” in the subject line. 

How to exercise these rights

Any requests to exercise User rights can be directed to the Owner through the contact details provided in this document. These requests can be exercised free of charge and will be addressed by the Owner as early as possible and always within one month.

Additional information about Data collection and processing

Legal action

The User’s Personal Data may be used for legal purposes by the Owner in Court or in the stages leading to possible legal action arising from use of this Application or the related Services.  The User acknowledges and understands that the Owner may be required to reveal personal data upon request of public authorities.

System logs and maintenance

For operation and maintenance purposes, this Application and any third-party services may collect files that record interaction with this Application (System logs) use other Personal Data (such as the IP Address) for this purpose.

Changes to this Privacy Policy

The Owner reserves the right to make changes to this Privacy Policy at any time by giving notice to its Users via this Application or other methods. It is strongly recommended to check this page often, referring to the date of the last modification listed at the bottom.

Definitions and legal references

 Personal Data (or Data) – Any information that directly, indirectly, or in connection with other information allows for the identification or identifiability of a natural person.

Usage Data – Information collected automatically through this Application (or third-party services employed in this Application), which can include: the IP addresses or domain names of the computers utilized by the Users who use this Application, the URI addresses (Uniform Resource Identifier), the time of the request, the method utilized to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server’s answer (successful outcome, error, etc.), the country of origin, the details of the device and the operating system utilized by the User, the various time details per visit ,and other parameters about the device operating system and/or the User’s IT environment.

User – The individual using this Application.

Data Controller (or Owner) – The natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of Personal Data, including the security measures concerning the operation and use of this Application. The Data Controller, unless otherwise specified, is the Owner of this Application.

This Application – The means by which the Personal Data of the User is collected and processed.

Service – The service provided by this Application as described in the relevant terms and on this site/application.
